Question: A few months ago, I caught up on my taxes and got a refund and my tax lien has since shown as "released" on my credit report. I know there is a NEW IRS regulation that allows for withdrawal IF the taxpayer requests it. How do I request it ? PS, please read below if you don't know of the new regulation that allows this. Liens will now be withdrawn once full payment of taxes is made if the taxpayer requests it. The IRS has determined that this approach is in the best interest of the government. In order to speed the withdrawal process, the IRS will also streamline its internal procedures to allow collection personnel to withdraw the liens. I feel sure that if the lien gets withdrawn, it will go back to around 769. (All else being pretty much the same, no debt except for minimal credit card usage that are paid in full every month)

Please use Form 12277, Application for Withdrawal (PDF). In item 8, “Reason for requesting withdrawal,” check box d, the “best interest” provision.

The best thing you can do right now is to take that note to the bank and let them know she has committed fraud and sold what was not hers to sell. They can proceed from there, and may also be able to tell you how to proceed. I would also file a police report as soon as possible and with as many details as possible. Let the seller know (with certified mail if possible) that you have done so and have contacted the actual owner of the vehicle. If that does not get a response, a lawyer should be your next stop. The dealer has the original title. They own the car. You can report the "seller" to the police for fraud. You might contact the lein holder and find out what the balance is. If it's worth it to you, you may decide to pay off the note. There are legalities in doing that, as the title is in the other person's name, held by the dealer, so that will take some finagling. This is the second instance on here. How can anyone pay cash for a car without receiving a clear title at the payoff? The other person may be prosecuted, but you still may not see any money.

in your quotation make note of the phrase, if the taxpayer requests it. this means to get the lien removed it is your responsibility to request it
